Merchant Terms
The rules for selling on Musuwo: accuracy, fulfilment, fees, and what gets a business suspended.
The indemnity, liability and suspension provisions, and the contractual relationship between Musuwo and a merchant, have not been reviewed by a Zimbabwean lawyer.
1. You are the seller
You sell to the customer. Musuwo lists you, carries the order to you and helps it reach them. The contract for the goods or services is between you and the customer.
That means the obligations that come with selling are yours: describing what you sell accurately, having it, supplying it, and dealing with the customer when something goes wrong.
2. Be who you say you are
Give Musuwo accurate identity and business information, and tell us when it changes. Applying with somebody else's identity or with invented details is grounds for immediate removal.
3. What verification means
Musuwo may record that it has checked, separately:
- your identity,
- your address,
- that you are actually trading,
- your business registration, where you have one.
A verified badge means those checks were done. It is not an endorsement of you, a guarantee of your products, or a promise about any transaction, and Musuwo will not describe it that way to customers.
4. Your listings
- Sell only what you have the right to sell.
- Do not list counterfeits, replicas passed off as genuine, or stolen goods.
- Prices must be the real price. Do not show a "was" price that was never
charged.
- Keep stock accurate. A listing you cannot supply wastes a customer's time and
costs you the next order.
- Photographs must be of what you are actually selling, and must be yours to
use.
- Do not list anything on the Prohibited Products
list.
5. Fulfilment
- Accept or decline promptly. An order that sits is a customer waiting.
- Supply what was ordered, in the condition described.
- Where you deliver, deliver within the time you gave.
- Tell the customer as soon as you know something is wrong.
6. Food and perishables
If you sell food, you are responsible for its safety: expiry dates, storage, handling and packaging for transport. A Terms page does not remove any obligation the law places on a food seller.
7. Returns and refunds
Follow the Refund and Returns Policy. Your customers' rights under Zimbabwean consumer law are not removed by Musuwo's policy or by yours.
8. Fees
At this version Musuwo charges no commission. The platform fee rate is set to zero.
If that changes:
- the rate will be published here as a new version,
- the fee in force at the moment of a sale is frozen onto that order, so a
later change never re-prices a past sale,
- you will be able to see, per order, what was sold, what Musuwo took and what
you are owed.
9. Getting paid
Customer payments are collected through Paynow Zimbabwe. Every confirmed payment is recorded with the business that earned it and what Musuwo owes that business. A payout is a separate recorded event with its own reference.
10. Promoted listings
If paid placement is introduced, a promoted listing will be clearly labelled to customers. Buying placement will never let you edit organic ranking, another merchant's listing, or your own performance figures.
11. Customer information
You receive customer details only to fulfil the order. You may not use them for marketing, sell them, keep them longer than you need them, or contact the customer about anything other than their order.
You may not see another merchant's customers, orders, products, analytics or finances, and Musuwo enforces that on the server rather than by hiding buttons.
12. Taxes and licences
Your tax obligations and any licence your trade requires are yours. Musuwo does not file anything for you and does not verify that you hold a licence unless it says specifically that it has.
13. Suspension
Musuwo may pause or suspend a business for: selling prohibited items, repeated failure to fulfil, fake listings or reviews, misuse of customer data, abuse of staff or customers, fraud, or a serious safety concern.
Where it is reasonable, you will be told why and you can respond. Serious safety and fraud cases may be acted on immediately.
14. Content you upload
You keep ownership. You give Musuwo permission to display it as part of running the marketplace. You confirm you have the right to use every image and description you upload.
15. If you cause a loss
Musuwo intends to be able to recover from a merchant where a loss is caused by illegal listings, infringement of somebody else's rights, or fraud. The precise wording has not been settled by a lawyer, and is flagged as outstanding rather than presented as final.
16. Ending it
You can stop selling at any time. Fulfil the orders you have already accepted.
17. Changes
Material changes get a new version and you will be asked to accept it. The record of which version you accepted is kept.
